The landlord attended the video hearing. The tenant did not attend. Two attempts were made to call the tenant’s phone number as provided in the application. 1 Both calls were unanswered and went to voicemail.

I am satisfied the tenant had been served with notice of today’s hearing, 2 therefore I proceeded in the tenant’s absence. 1 The phone number provided is the phone number stated in the tenancy agreement. The landlord stated that phone number was the only contact number for the tenants.

By order dated 26 February 2025, the landlord was refunded the bond, and the tenant was ordered to pay the landlord rent arrears to 19 February 2025 (less the bond). The landlord says that debt remains unpaid.

In this new application, the landlord seeks compensation for outgoings (water), and the cost of replacing a garage door remote and keys not returned at the end of the tenancy. The landlord also seeks reimbursement of the filing fee and suppression of the landlord’s name.

How much is owed water rates?

The landlord provided water rates invoices (invoices from the property manager to the tenant, and also the Watercare invoices) which prove the amount owing at the end of the tenancy.

The invoices record the tenant was charged a total of $948.11 for water consumption for the period 27 June 2024 to the end of the tenancy. The landlord states the tenant has not made any payments towards those water charges.

The amount ordered is proved.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must return all keys and security devices pursuant to section 40(1)(e)(iv) of the Residential Tenancies Act 1986 (RTA).

The landlord has provided a “Documentation and Access Information Receipt” which records that at the start of the tenancy, the tenant was provided two garage door remotes and six keys. The landlord says the six keys were three copies of the front door key, and three copies of the garage side door key.

On 19 February 2025 (the last day of the tenancy), the tenant did not return the keys or garage door remotes. The landlord states attempts were made to contact the tenant to request return of the keys and remotes, but neither were returned by 4 March 2025.

The landlord has provided an invoice from a locksmith dated 4 March 2025 for $252,87 for the cost of replacing the keys to the front door and garage side door.

The landlord has also provided an invoice from a garage door tradesperson dated 9 April 2025 for $334.99 for the cost of replacing one garage door remote.
