The hearing proceeded by way of telephone conference. [The property manager], Property Manager, attended the hearing for the landlord. The tenant appeared.

The parties signed a one-year fixed-term tenancy agreement that began on 7 August 2024 which is due to end on 5 August 2025.

On 9 May 2025 the landlord filed an application with the Tribunal seeking termination of the tenancy for breach of the tenant’s obligations, rent arrears, refund of the bond and compensation for breaches of the Body Corporate rules. Rent arrears

Under section 55(1) of the Act, the Tribunal must, subject to subsection 55(2) terminate the tenancy, if at the time the application was filed, the rent was at least 21 days in arrears.

Under section 56(1) of the Act, the Tribunal may terminate a tenancy if the tenant has failed to remedy a 14-day breach notice for rent arrears, and it would be inequitable to refuse termination.

Under section 56(2) of the Act, if an application is made under section 56(1) and, at the time of the hearing the rent was at least 21 days in arrears, the Tribunal shall determine the application as if it had been made under section 55(1) and (2) of the Act.

The landlord provided up to date rent records which prove the amount owed. The tenant took no issue with the records and said they were not able to pay rent due to their bag being stolen and bank account hacked. No evidence to substantiate these claims was provided.

The landlord issued a 14-day notice on 28 April 2025 advising the tenant they were $820.00 in rent arrears. The notice expired on 12 May 2025. The tenant made one rent payment of $500.00 on 9 May 2025. The notice has not been remedied.

At the date of hearing the tenant’s rent arrears totalled $2022.54. The rent is more than 21 days in arrears. The tenancy is terminated.

Having considered the submissions of both parties I am satisfied that it is appropriate to terminate the tenancy at midnight on Wednesday 25 June 2025. Compensation for Body Corporate Costs.

The landlord seeks compensation for breaches of the body corporate rules and associated administration costs and provided invoices for the same. The issues surrounding the behaviour that led to the invoices being issued has been dealt with on a previous occasion by the Tribunal 1 . The issue of res judicata applies. The matter has been previously adjudicated upon between the same parties suing in the same right. It was appropriate for the landlord to seek compensation for these breaches at that time. On that basis the Tribunal declines to hear the claim again. Costs
