A hearing was convened by teleconference on 24 September 2025. The landlord attended the hearing. The tenant did not attend. The Tribunal made unsuccessful attempts to contact the tenant on the number provided in the application. I am satisfied that the hearing notice was properly served on the tenant and that the tenant was given a reasonable opportunity to attend and be heard. It was appropriate for the hearing to proceed in the tenant’s absence. Procedural History

This matter was previously heard on 28 July 2025. At that time, the Tribunal awarded rent arrears to 12 July 2025 in the sum of $691.86. The bond of $248.00 was also awarded to the landlord, leaving a remaining balance of $443.86 payable by the tenant. That earlier monetary order is to be incorporated into the current order.

The present hearing was a reconvened matter to determine the landlord’s remaining claims for damage to the premises following the end of the tenancy. The Claims

The landlord seeks compensation for damage caused to the property during the tenancy. The landlord provided detailed photographs showing the damage. These included damage to windows and glass panels in the front door. The photographs were consistent with the nature of the claims and provided visual corroboration of the property’s condition.

In addition to the photographic evidence, the tenancy manager gave oral evidence. He had reviewed video surveillance footage from 1 July 2025. That footage clearly showed the tenant engaging in conduct that directly caused the damage. The damage observed included the tenant breaking windows and damaging the glass panels in the front door. The Tribunal accepts this evidence as credible and compelling.

The landlord provided two invoices to support the claimed costs. The first invoice, in the amount of $1,296.00, related to the initial urgent callout and securing of the property. The second invoice, in the amount of $4,761.00, covered the subsequent repair work undertaken to restore the damaged areas. Both invoices were clear, itemised, and consistent with the extent of damage shown in the photographs and described by the tenancy manager. Analysis

Under section 40(1)(d) of the Residential Tenancies Act 1986 (the RTA), a tenant must not intentionally or carelessly damage the premises. Where damage is intentional or caused through gross carelessness, the tenant is fully liable for the cost of remediation. In this case, the landlord has established that the damage was caused directly by the tenant, as evidenced by video surveillance and supported by photographs and oral evidence. The Tribunal is satisfied that the damage was intentional.

Section 49 of the RTA permits a landlord to claim compensation for damage to the premises that exceeds fair wear and tear. The evidence presented leaves no doubt that the damage in this case was well beyond the scope of fair wear and tear and was the result of wilful acts.

The claimed amounts are supported by professional invoices and reflect costs that are reasonable and proportionate in the circumstances. The landlord is therefore entitled to be compensated in full for the repair costs. Conclusion

The landlord has successfully established claims for intentional damage caused by the tenant. The amount of $6,057.00, comprising the two repair invoices, is awarded in full. In addition, the previous order for $443.86 in rent arrears is incorporated into this decision, bringing the total amount payable by the tenant to $6,500.86.

As the landlord has been wholly successful in the application, I must order the tenant to reimburse the filing fee pursuant to section 102(2) of the RTA.
