Reasons

Both parties attended the hearing.
The landlord and the tenant signed a fixed term tenancy on the 17 April 2025 for a tenancy to commence on the 30 April 2025. Shortly after the fixed term contract was signed the tenant’s existing landlord offered her to allow her to stay in her existing property. The tenant asked to be released from the fixed term contract. The landlord agreed to release the tenant on the proviso that the tenant was liable for the rent from the 30 April until new tenants were found.
The landlord says that they immediately advertised the property. The new tenants were found and their tenancy commenced on the 24 May but the landlord only seeks rent until the 20 May. The landlord is not seeking any costs associated with reletting the property.
The tenant accepts that she is liable for the rent, because she had signed a tenancy agreement, but was aggravated because: a) that the landlord did not deal with the matter until the Tuesday, when the tenant had sent an email on the Friday. b) That the tenant offered to pay the debt back but says that the landlord demanded the full amount or in 4 payments which the tenant could not afford.
The tenant was bound by the contract she signed and therefore she is liable for the rent sought. I therefore make an order for the rent until the 20 May.
I record that the day that the tenant sent her email asking to be released was on Good Friday, a public holiday, and I consider it reasonable that the landlord only replied to the email the following Tuesday when she was back at work.
I record that the tenant offered to pay the rent arrears amount by $50 per week today, but that the landlord refused to accept that offer. The tenant tells me that is the maximum amount that she can afford to pay.
The landlord has been successful in their claim and is entitled to the filing fee.
