Reasons

The landlord attended the hearing on 2 October 2025 by telephone. I telephoned the tenant however the number did not connect. I continued with the hearing as the tenant has been emailed notice of the hearing date and time to her address for service.
The landlord has applied for rent owing and compensation for the cost to remove rubbish left at the property following the end of the tenancy.

How much is owed for rent?

The tenancy ended on 24 March 2025 when the landlord entered the premises to confirm it had been abandoned, decided it had been, and took possession.
The landlord sent many texts and tried calling the tenant between 20 and 24 March 2025. She texted him on 21 March 2025 to provide a new phone number, but the landlord says this was the last communication he received from her.
The landlord also spoke to a third party who was in contact with the tenant. He says this person told him that the tenant had moved out to live in another suburb.
I accept this evidence. The landlord claims rent owing up to 31 March 2025. This is the date 7 days after the landlord decided the premises had been abandoned.
Rent records have been supplied which prove the amount owing to 31 March 2025 is $2,742.86.
I award the rent claimed because, legally, a tenant who abandons a property is liable for rent for the legal notice period; section 61(3) Residential Tenancies Act 1986 (RTA). Rubbish disposal costs
A tenant must leave premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all landlord chattels. Section 40(1)(e)(ii)-(v) RTA.
The landlord says the tenant did not leave the premises reasonably clean and tidy and did not remove all rubbish. The landlord claims $2,271.25 for the cost of five skip bins which it says were needed to remove belongings, rubbish and building materials from the property.
The landlord has supplied invoices for the skip bins.
The landlord has not provided any photographs to support this claim. This is a claim for a large amount so photos of the items that needed removing and (ideally) of the skip bins is required.
I allowed the landlord additional time so supporting evidence could be given to the Tribunal, but no new evidence has been received.
I therefore dismiss the claim for the cost of the skip bins.
The filing fee is awarded as the claim is successful.
The bond is refunded to the landlord. The balance is payable to the landlord by the tenant.
No name suppression orders apply.
