Reasons

Both parties attended the hearing.

The tenant has applied for reduction of the fixed-term tenancy due to end on 7 August 2025.

The Tribunal may reduce a fixed term tenancy where: a. there has been an unforeseen change in the applicant’s circumstances; and b. there would be severe hardship to the applicant if the term is not reduced; and c. the applicant’s hardship would be greater than the hardship to the other party if the term is reduced. See section 66(1) Residential Tenancies Act 1986 (RTA).

There has been an unforeseen change in the tenant's circumstances. The tenant explained that the tenancy commenced in August 2024, while she was living in the relevant town, was working, and earning a good wage. In November 2024, the tenant unexpectedly lost her job. She endeavoured to find new employment without success and as a result, experienced depression, and declining health. The tenant has now relocated to Hamilton where she can have support caring for her children. She is currently paying rent at a new property and has support from WINZ to do so.

The tenant would suffer severe hardship if the term of the tenancy were not reduced. The tenant is unable to cover rent in both properties and submits that she is barely able to cover current living costs.

The landlord would also suffer hardship if the term were reduced and requested that the tenancy term not be reduced at all. The landlord has been advertising the property since 10 June 2025, including paying for premium listings, but has not been able to secure a new tenant and explains that it is a difficult market. The property has a mortgage, and the loss of rent will make it difficult to cover the mortgage.

On balance, I find that the tenant’s hardship would be greater than the landlord’s hardship.

Where the Tribunal reduces a fixed-term tenancy, it may order the tenant to pay the landlord reasonable compensation for any resulting loss. See section 66(2) RTA.

I award compensation of $2,016.43 to the landlord. This includes $500.00 in break lease fees that the tenant has agreed to cover and rent through to the end of the tenancy dated ordered, being 11 July 2025. I note that this includes a deduction for the $50.00 payment that the tenant has provided evidence for, that has not yet been receipted in the rental summary.

Although I sympathise with the tenant and her current financial predicament, in my view it is fair and reasonable that the tenant pay rent until 11 July 2025. If unable to obtain a new tenant, the landlord could potentially suffer loses until the end of the tenancy term because of the reduction.

Because [The applicant/s] has wholly succeeded with the claim by reducing the fixed term tenancy, I must reimburse the filing fee.

Both parties sought name suppression. As the tenant has successfully reduced the tenancy term, name suppression is granted. I am also satisfied that in the circumstances and having regard to the interests of the parties, consider that it is also appropriate for the landlord to have name suppression.
