The tenant [The tenant/s] is liable to the landlord The Good Girls Property Management Limited for the sum of $1,060.00 (“the debt”), representing rental arrears up to 3 June 2025.

[The tenant/s] must continue to pay rent and repay the debt as follows: a. Weekly rent payments of $440.00 are to be made in accordance with the tenancy agreement, no later than two working days after each due date; and b. The debt is to be repaid in 10 fortnightly instalments of $100.00, followed by a final payment of $60.00. Payments are to be made every Tuesday, commencing on 1 July 2025 and continuing until 25 November 2025, with each payment due no later than two working days after the scheduled date.

If the tenant fails to make three consecutive weekly rent payments and/or the fortnightly debt repayments: a. The tenancy at 652B Gloucester Street, Linwood, Christchurch 8062 will be terminated, and the landlord will be entitled to immediate possession of the premises; and b. The remaining balance of the debt will become immediately payable in full.

Reasons

Both parties attended the hearing.

The landlord applied for a conditional termination of the tenancy, rent arrears, and a refund of the bond. The tenant indicated a willingness to repay the debt to avoid immediate termination.

Under section 56(1) of the Residential Tenancies Act 1986, the Tribunal may terminate a tenancy where a breach has occurred and, due to its nature or extent, it would be inequitable to decline termination. Where the breach is capable of being remedied, the landlord must first serve notice requiring the tenant to remedy the breach within a minimum of 14 days and must show that the tenant failed to comply.

The tenant breached his obligations by failing to pay rent when due. On 7 April 2025, the landlord issued a 14-day notice to remedy the breach. The breach was not fully remedied within the required timeframe. Given the ongoing arrears and absence of a clear repayment plan, it would be inequitable to refuse termination of the tenancy.

The evidence presented shows that the tenant has access to some support services and individuals who, under a conditional termination arrangement, may assist in securing stable funding to meet his rental and basic living expenses. The tenant receives a fortnightly pension, while rent is payable weekly. He also earns a variable and seasonally low income from part-time taxi driving. Although WINZ has previously declined accommodation assistance based on his taxi income, it appears there may be a need for a reassessment of his current financial situation. The tenant is encouraged to explore this further with available support services, and the landlord has offered to assist with this process.

Despite the finding that refusal to terminate would be inequitable, based on the evidence, I am satisfied that the tenant is likely to comply with the repayment terms outlined in the order and unlikely to commit further breaches. Accordingly, a conditional termination has been granted pursuant to section 78(3) of the Residential Tenancies Act 1986.

The conditional termination order will lapse if fully complied with. If the tenant breaches the conditions of the order, a possession order becomes enforceable within 90 days from the date of the first breach, in accordance with section 64(4)(b) of the Act.

As the landlord did not seek reimbursement of the filing fee, no such order is made.
