Reasons
- Both parties attended the hearing by telephone.
- On 16 June 2025 the Tribunal made an order relating to this tenancy, for rent arrears, repairs and made a determination on break fees up to the date of the hearing.
- The previous order is incorporated into this order for enforcement purposes.
- The case was adjourned at that time for the final break fee costs to be submitted. I heard the evidence in relation to this today.
- Whilst there was some debate in relation to the evidence there appeared to be a misunderstanding in relation to all of the invoices filed that included the invoices that were determined at the previous hearing.
- However, having considered all of the evidence and submissions I am satisfied that the costs sought are proven and reasonable in relation to the break fees associated with termination of the fixed term tenancy. That is the determination from the previous hearing and the additional invoice of $560.44.
- In future it would assist if the hearing was adjourned to consider all costs of the break fee at a later date, with one invoice for the fees submitted.
- It is noted that further submissions were filed by the applicant after the hearing had concluded. This has not been taken into consideration and is inappropriate. Both parties must have the ability to consider all evidence in relation to the case and respond accordingly.
- Because Spectre Property Management Services Limited - As Agent For Graeme Andrew Weller/Weller Family Trust Ltd has wholly succeeded with the claim I must reimburse the filing fee.
