Reasons

In my previous order dated 01/09/2025 I specified that the weekly payment of $100.00 would be allocated $88.00 to rent and $12.00 to the debt. This was based on the previous rent amount. Rent is now $90.00, and the correct apportionment is $90.00 to rent and $10.00 to the debt. All other matters in the order remain the same. Reasons:

The applicant attended the hearing by phone. The respondent did not attend.

The applicant has asked me to make a conditional termination order. They tell me the respondent attended their offices and negotiated an arrangement for rent plus $10.00 per week.

The default is usually that the respondent needs to be present so that I can be satisfied that they are willing and able to make the payments. If they do not attend the adjudicator will usually order immediate termination if the conditions are met.

The applicant has however provided me with a rent summary which reflects that the respondent has been making the extra payments of $10.00 per week which gives me confidence that what the applicant told me about the negotiated agreement is correct. I also know something of the respondents’ circumstances from the previous hearing too and I would rather give them the benefit of the doubt for todays non attendance rather than taking an overly technical approach.

Should a conditional termination order be made?

Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.

I am satisfied the tenant will pay the debt within the period specified in the order and is unlikely to commit any further relevant breach. I have granted a conditional termination order.

The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.
