The landlord has applied for compensation and refund of the bond and reimbursement of the filing fee following the end of the tenancy.
At the hearing the Landlord withdrew their claim for refund of the bond.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986. The tenant is required to replace worn out smoke alarm batteries during the tenancy. See section 40(1)(ca) Residential Tenancies Act 1986. The tenant must also replace standard light bulbs.
The Landlord claimed the Tenant did not leave the property clean and tidy because the carpet had stains which required professional carpet cleaning. The Tenant acknowledged that they had two cats at the property that were not initially consented to until after it was discovered they were residing there. The Landlord provided photographs of the stains which were visible however the source of the stains was not known. The Landlord did not want a rug doctor being used as this created residue on the carpet. An invoice was provided for the carpet cleaning.
The Tenant acknowledged the stains and submitted that they offered to use a “rug doctor” to remove them however the Landlord refused and insisted they use a professional carpet cleaning service. They submitted that they were not aware of any laws that required them to use professional carpet cleaners.
Under section 40(1)(e) of the Residential Tenancies Act 1986, tenants must leave the premises “reasonably clean and reasonably tidy” at the end of the tenancy.
In considering the evidence, there were stains in the carpet at the end of the tenancy and regardless of their source, the Tenants should have taken reasonable steps to remove them. This includes professional cleaning by a carpet cleaning professional. As the Tenants efforts did not remove the stains, it is reasonable that they reimburse the Landlord for their costs in hiring a professional carpet cleaner to do so.
For this reason, the amounts ordered are proved.
As the Landlord has been wholly successful with their claim, the Tenant shall reimburse the filing fee.
