Reasons

This application was scheduled to be heard by teleconference. I rang the four numbers provided for the tenant, twice each, and all calls went to voicemail. The hearing proceeded in her absence.
The landlord has applied for the insurance excess payable for having the living room, dining room and kitchen area remediated as a result of methamphetamine contamination. The landlord also seeks reimbursement of the filing fee.

Is the tenant responsible for methamphetamine contamination?

A tenant is responsible for remediating contamination which occurred during the tenancy.
I accept the evidence that the premises were brand new at the beginning of Ms Leigh’s tenancy.
I also accept the evidence that after she vacated the premises, the house was tested for methamphetamine contamination.
The test report shows that the kitchen had a level of 6.1mg/100cm 2 and the lounge test returned a level of 15.6mg/100cm 2 .
For the past few years the Tribunal has accepted that the level at which premises could be regarded as contaminated is 15mg/100cm 2 .
On this evidence I find that the tenant is responsible for methamphetamine contamination of the lounge area of the premises.

How much ought the tenant to pay?

I accept the evidence that the cost of remediating the contaminated area was $3,967.50 and the insurance excess payable on this cost was $2,500.00.
The tenant is therefore required to reimburse the excess payable to the landlord – see s49B of the Residential Tenancies Act 1986.
I am also ordering the tenant to reimburse the filing fee to the landlord because the landlord was wholly successful with their claim against her. C ter Haar 09 September 2025
