Should the tenancy be terminated?

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. See section 56(1) Residential Tenancies Act 1986.
Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so.
The tenant has breached their obligations by failing to occupy the premises as required by clause 14 of the tenancy agreement.
The landlord served a 14-day notice on the tenant on 2 May 2025 requiring the tenant to resume living at the property by 27 May 2025. The tenant has not resumed occupation of the property and has not contacted the applicant to discuss her situation. The landlord has subsequently become aware that the tenant cannot return until at least September 2025. She is therefore also in breach of clause 15 of the tenancy agreement which requires her to notify the applicant if she is not occupying the premises for more than 30 days.
The tenant did not, and it appears likely she cannot remedy the breach within the required period.
It would be inequitable to refuse to terminate the tenancy because of the nature of the breach, the likelihood that the breach cannot be remedied for quite some time and the fact that as the house is social housing the applicant has a duty to ensure it is occupied by those in need of housing.
The landlord has also applied for rent arrears and has provided rent records which prove the amount owing. The amount awarded is until today only. The rent statement calculates rent until 16/7/2025 so the rent is recalculated until today.
