This order amends the date for the termination of the tenancy, but in all other respects the Tribunal’s order dated 11 August 2025 remains unchanged.

The tenancy of John Richard Powhare ( also known as ) Sione Richard Pongi at 50 Gear Terrace, Ranui, Porirua 5024 is terminated, and possession is granted to Kainga Ora-Homes And Communities as 11.59 am on Friday 15 August 2025.

Reasons

The landlord attended the remote hearing.

Telephone calls were made to the tenant on the number provided at the allocated hearing time. All calls went to voicemail. The Tribunal may hear matters in the absence of a party where satisfied that notice of the hearing has been given. I am satisfied that notice of the hearing was given to the tenant.

The landlord has applied for termination of the tenancy for breach of the tenant’s obligations.

Should the tenancy be terminated?

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. See section 56(1) Residential Tenancies Act 1986.

Where the breach is capable of remedy, the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so.

The tenant has breached their obligations by failing to reside at the premises.

The landlord served a breach notice on the tenant on 4 April 2025, and the tenant did not remedy the breach within the required period. The landlord’s evidence was that the tenant had been bailed by the court to reside at premises in Kawerau and has lived there since that time. The landlord carried out a home visit along with the police on 1 August 2025. The police confirmed that the property was in very poor condition with evidence of rodents present.

It would be inequitable to refuse to terminate the tenancy because the tenant has failed to comply with the breach notice and has, at the date of the hearing, failed to return to reside at the premises.
