If the tenant fails to make any payment within 2 working days of the due date, the balance of the debt owing will be payable immediately and can be enforced through the District Court.

Reasons

Both parties attended the hearing today.
The landlord applied for compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.
A previous Tribunal order dated 8 April 2025 terminated the tenancy and awarded rent arrears but did not refer to the bond of $2,920.00 (application 5175651). I understand that the bond has been refunded to the landlord. The bond is deducted from the amount awarded.
The exit inspection report supports the claim for damage brought by the landlord. The garage carpet was replaced because it had been soiled by pets; there was damage to the walls in the lounge and bedrooms 2 and 3; several curtains and blinds were dirty and had to be replaced. The shower mixer was broken in the main bathroom.
The landlord’s insurers paid for repairs (invoiced at $13,529.75) and deducted the excess of $650.00 for each main item of damage. The landlord is claiming $6,500.00 as the uninsured loss. The tenant did not dispute the claim for repair, but I am in any event satisfied that it is appropriate to make this order (in other words, the damage claims are established to the civil standard of proof).
There is a claim for deep cleaning in the sum of $1,980.00 plus GST. The landlord said there was widespread staining from smoking in the property. There was no insurance cover for cleaning. I have included the cleaning cost in the award. If I am mistaken about the insurance cover, the landlord can request an amendment to this order.
I note that insurers paid $8,950.00 for loss of rent from 7 January to 31 March 2025 (12 weeks). The Tribunal awarded rent arrears of $9,983.00 to 8 April 2025. The landlord will presumably give the tenant credit for the insurance recovery when enforcing the previous order for rent.
