The Rent Shop Limited must pay [The tenant/s] $78.00 immediately, calculated as shown in table below:
The notice of inspection issued by the landlord on 27 May 2025 is invalid.

Reasons

Both parties attended the hearing.
[The tenant/s] claims the landlord has entered the premises in breach of the Residential Tenancies Act 1986.
A landlord may not enter the premises during the tenancy except with the tenant's consent, in an emergency, or after giving the required notice for inspections and repairs and maintenance. See section 48(1) and (2) Residential Tenancies Act 1986 (‘RTA’).
Breaching this obligation is an unlawful act for which exemplary damages may be awarded up to a maximum of $1,500.00. See section 48 (4)(a) and Schedule 1A Residential Tenancies Act 1986.
The tenant has on the date of inspection on 12 June 2025 at about 10.30am, gave consent freely to the landlord’s property manager to inspect the premises. A landlord may enter the premises with the consent of the tenant freely given at, or immediately before, the time of entry as set out under section 48(1)(a) RTA.
Accordingly, the landlord has not committed any unlawful act in respect of entry on 12 June.
That said, the landlord’s notice dated 27 May 2025 for the inspection to take place on 12 June 2025 is outside the timeframe allowed for the notice under section 48(2)(b) RTA.
Section 48(2)(b) RTA provides that for the purpose of inspecting the premises, the landlord’s notice given to the tenant must not be less than 48 hours nor more than 14 days before the intended entry. The notice given on 27 May is more than 14 days before the intended entry on 12 June 2025 and therefore ineffective and of no effect.
I make an order declaring that the 27 May notice invalid.
The Rent Shop Limited enquired whether the tenant is entitled to refuse a landlord entry to the premises when they were entitled to enter section 48(2) Residential Tenancies Act 1986.
I consider that tenants can stipulate reasonable conditions for entry and withhold his or her consent reasonably and may make the consent for entry subject to any reasonable conditions.
Lastly, I consider that landlords can reasonably stipulate a 2 hour window for the intended inspection to take place.
I award the tenant $50.00 for the inconvenience caused by the invalid notice of inspection as well as reimbursement of the filing fee by the landlord.
