Reasons

- The hearing took place in [Event location suppressed] on 22 August 2025. Ms Gray, representing Kāinga Ora, attended the hearing by phone with the consent of the Tribunal. There was no appearance by the tenant.
- Kāinga Ora’s rent record shows that: a. The rent was more than 21-days in arrears when this application was filed. b. The rent arrears will be $3,083.57 at the end of the current rent week (25 August 2025).
- Ms Gray said that she spoke with [The tenant/s] and they reached an agreement that [The tenant/s] would pay $18.00 per week in addition to the current rent of $162.00 per week, to address the arrears.
- Ms Gray noted that the tenant’s rent is now on re-direction from WINZ, and the $180 payments came though on 12 August and 19 August.
- Ms Gray confirmed that this arrangement is acceptable to Kāinga Ora.
- Kāinga Ora has the right to a termination order because the rent was more than 21-days in arrears when the application was filed.
- The Tribunal may make a conditional order if the Tribunal is satisfied that: 1 a. The tenant will be the arrears within a specified period; and b. The tenant is unlikely to commit any further breach of their obligation to pay rent.
- Those conditions are met in this instance. The tenant has taken steps to follow through on her agreement to pay off the arrears at $18 per week.
- Given that this order is essentially formalising a mediated agreement between Kāinga Ora and the tenant, it is appropriate to grant name suppression to the tenant.
