Should the tenancy be terminated?

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. See section 56(1) Residential Tenancies Act 1986.

Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so.

The tenant has breached their obligations by allowing other people to reside at the property in breach of the express terms of the social housing tenancy, hoarding of materials at the premises which causes a fire and safety hazard, failing to keep the premises reasonably clean and tidy, tampering with smoke alarms and the fire door and installing unsafe gas bottles cooking facility.

The landlord served 14-day notices on the tenant but the tenant did not remedy the various breaches within the required period.

It would be inequitable to refuse to terminate the tenancy because the tenant is unable/unwilling to part ways with her partner or ex-partner and the landlord is unwilling to include an additional occupant to the premises.

The numerous belongings on the premises are not able to be removed from the premises within a reasonable timeframe.

The tenant requests 90 days to vacate the premises. The landlord is prepared to allow the tenant 1 month to vacate.

I consider 1 month’s time appropriate under the circumstances provided that the immediate health and safety hazards are remedied and attended to by the tenant immediately.

The parties agreed for an inspection to take place by the landlord in a week’s time to ensure that the tenant complies with the above directions.
