The tenancy at 66 Monowai Place, Westbrook, Palmerston North 4412 is terminated immediately and possession granted to Kāinga Ora–Homes And Communities.

Reasons

The landlord attended the hearing. There was no appearance for the tenant.
The landlord has applied for termination of the tenancy and rent arrears.
Rent was at least 21 days in arrears on the date the application was filed on 1 August 2025, when the arrears were $3,123.26.
Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.
The grounds for termination under section 55(1)(a) are made out.
Although the tenants have reduced the arrears in the meantime, and the arrears are now down to $1,399.46, I am not satisfied that I can make a conditional order for termination under section 55(1A), which requires the Tribunal to be satisfied that: a. the tenant will pay the debt within a specified period or b. the tenant is unlikely to commit any further relevant breach.
The tenants have been in arrears to some degree for all of their tenancy. They have occasionally made sums that have reduced the outstanding amount, but have never fully cleared the debt, which by the end of 2023 was over $4000.
Between 29 December 2023 and 18 March 2025, the tenants made regular payments of rent plus $10 a week for arrears, reducing the debt to $3,177.86.
Since their income-related rent was increased in March 2025, they have not increased their payments, and have therefore allowed the debt to increase to $4,496.66 by May this year. Since then they have made occasional lump sum payments but have never increased their weekly rental to the $431 being charged. There is no pattern with the lump sums. The tenants did not attend the hearing to explain: a. How or when they will pay the outstanding amount b. Why they are unlikely to commit any further breach.
Therefore there are no grounds for the Tribunal to make a conditional order. The tenancy is terminated immediately.
Because the landlord has been wholly successful, I must reimburse the filing fee.
