Reasons

Both parties attended the teleconference hearing. After a series of interruptions by the tenant during the hearing, and warnings that she would be removed if the interruptions did not stop, the tenant abruptly left the hearing a few minutes before the hearing finished.

The landlord has applied for termination of the tenancy and for rent arrears.

Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.

How much rent is owing?

The landlord provided rent records which prove the amount owing to 29 September 2025, which is $11,831.42. The tenant took issue with this, as the last rent payment shown on the landlord’s bank account was on 23 July 2025 and she said she had made three more payments in August 2025 that were not reflected in the landlord’s bank statement or rent summary. The tenant was given the opportunity to email in screenshots of these payments during the hearing, which she did. Three screenshots showed payments made by the tenant of $450.00 on 1 August 2025, $220.00 on 3 August 2025 and $450.00 on 3 August 2025.

The landlord said they definitely did not receive any of the additional payments that the tenant said she made in August 2025. They pointed out that the copy of their bank statement provided was certified by the bank on 22 September 2025 and showed all transactions payments received into this rental account over the period from 2 April 2025 to 22 September 2025. I accept the landlord’s certified copy of their rent bank statement, certified on 22 September 2025, and accept that the statement includes payments up to 22 September 2025, as has been certified by the bank.

The District Court has confirmed that rent is considered to be paid when it is received by the landlord, not when it is, or is said to have been, paid by the tenant. 1

As the tenant’s three payments in August 2025, as outlined above, are not reflected on the landlord’s certified bank statement, they are deemed not to have been received by the landlord. The tenant will need to sort out this payment issue with her own bank.

It is noted that, even if the tenant’s three payments in August 2025 had been considered in the rent arrears owing, the rent arrears would still have been more than 21 days in arrears, by a significant amount.

Therefore, the tenant owes the landlord a total of $11,831.42 in rent to 29 September 2025, which is the end of the tenancy.

Both parties requested name suppression.

As the landlord has been successful with the claim, they are entitled to name suppression. Therefore, I order that the landlord’s name and identifying details and the tenancy address are not to be published. See section 95A(1) Residential Tenancies Act 1986 (“RTA”).

Section 95A(4) RTA provides that the Tribunal may, on the application of any party to proceedings or on its own initiative, having regard to the interests of the parties and to the public interest, order that all or part of the evidence given or the name or any identifying particulars of any witness or party not be published.

Whilst the tenant requested name suppression, there was no evidence provided by the tenant for or during the hearing to show that the tenant’s interests outweigh the public interest in publishing her name. Therefore, I do not grant name suppression to the tenant.
