Reasons

The landlord attended the hearing represented by [The landlord’s representative]. [Tenant 1] also attended. I telephoned [Tenant 2] twice during the hearing, but she did not answer the phone.
The landlord has applied for compensation, refund of the bond, and reimbursement of the filing fee following the end of the almost four-year tenancy.

Did the tenant comply with their obligations at the end of the tenancy?

The landlord claims reimbursement of the costs they were put to in having the property cleaned, rubbish removed, and power reinstated.
Their evidence is that the property had significant mould present throughout when the tenancy ended. The mould was to the extent that it was classified at “bio-hazard” levels and the cleaner had to wear PPE. [Tenant 2], who was the only one residing in the property at the end of the tenancy, had disconnected the electricity to the property in 2023 and had not ventilated, cleaned nor heated the property since that time. As the electricity had been disconnected for so long the landlord was also put to the cost of having it reconnected and checked.
At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
The landlord has established their claims in evidence and [Tenant 1] agrees to pay the debt off at a rate of $50 per week. He has already been making payments of this nature towards the debt.
Because this order was essentially made by consent, [The landlord/s] have been successful in their claim and the mental health concerns discussed at the hearing, I consider it just 1 to make suppression orders in favour of both parties.
