Reasons

Both parties attended the hearing which was held by teleconference.

The landlord has applied for termination of the tenancy, an order for the removal of dogs, compensation for repairs to the property, reimbursement of the filing fee and payment of the bond. The tenant wants to comply with a work order to remove the dogs to avoid immediate termination and to repay the debt.

Should a conditional termination order be made?

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days, and establish that the tenant has failed to do so. See section 56(1) Residential Tenancies Act 1986.

The tenant breached their obligations by keeping dogs at the premises she rented from the landlord. On 21 July 2025 and 14 August 2025 the landlord served a 14-day notice on the tenant but the breach was not remedied within the required period. I am advised by the tenant that 3 dogs remain at the property.

It would be inequitable to refuse to terminate the tenancy because the dogs kept by the tenant have caused considerable damage to the premises. I also note that the tenant has kept dogs at the premises since 2022, in clear contravention of her tenancy agreement.

Despite my finding that it would be inequitable to refuse to terminate the tenancy, having heard the evidence I am satisfied the tenant understands that her tenancy will terminate if she fails to have the remaining 3 dogs at the premises removed by midnight on Wednesday 22 October 2025.

I have therefore granted a conditional termination. See section 78(3) Residential Tenancies Act 1986.

The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order is enforceable for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.

I am also satisfied that the tenant, accepting that there has been considerable damage to the premises, will pay the calculated cost of repair and the filing fee as per the payment schedule described above.

She understands that if she fails to keep to the payment schedule then the whole of the amount remaining falls due immediately. C ter Haar 15 October 2025
