The tenant did not attend the hearing and not answer the multiple calls made to her phone during the hearing. She had been notified of the hearing by email and text, however did not attend. Accordingly pursuant to section 92 of the Residential Tenancies Act 1986 (RTA) the hearing continued in her absence.

Kāinga Ora initially applied for an order directing [the tenant/s] to allow the landlord and their agents entry into the property as she had allegedly been refusing access. However, subsequent to the claim being filed, they have amended their claim to seek termination of the tenancy pursuant to section 55(1)(c) of the Residential Tenancies Act 1986 (RTA).

Kāinga Ora say that [the tenant/s] has assaulted a neighbour and attempted to assault, and threatened tradespeople contracted by Kāinga Ora to attend to maintenance on the premise. Specifically, as follows: a. On 7 September 2025 they say [the tenant/s] visited the neighbour’s house when she had locked herself out. They assisted by calling Kāinga Ora and asking for a locksmith. During the conversation [the tenant/s] allegedly became aggressive, spilled water on the neighbour, spat on them and their property, attempted to take the neighbours phone, grabbed the neighbour’s glasses from her face and tried to grab the neighbour’s clothing. b. Trades have reported [the tenant/s] to be aggressive, throw chairs, spit, verbally abuse them and fail to cooperate. c. Police were called to one trade’s visit. d. Another neighbour contacted Kāinga Ora last night to complain of excessive noise [the tenant/s] was making in the middle of the night.

Section 55(1)(c)(iii)&(v) of the RTA states that the Tribunal shall make an order terminating the tenancy if the tenant has assaulted or threatened to assault an agent of the landlord or any neighbour of the premise.

As applicant, Kāinga Ora has the evidential burden to establish that [the tenant/s] has committed such an assault to the civil standard of proof, the balance of probabilities. Evidencing the incident with the neighbour they provided the audio recording of the phone call, police report and a statement from the neighbour. The neighbour was also available to give oral evidence at the hearing.

Kāinga Ora have also provided incident reports from the tradespeople, the safety incident log and notes form the Housing Support Manager. Kāinga Ora staff were also available to give oral evidence at the hearing.

Having assessed the evidence available very carefully, I am satisfied that Kāinga Ora have established to the required standard that [the tenant/s] has assaulted a neighbour and been threatening and abusive to tradespeople. Sadly, it appears her health has been in decline recently and she is in need of extra support.

As an assault has been proven, I must terminate the tenancy. I have nominated the end of the weekend for the end date of the tenancy however am aware that Kāinga Ora will attempt to work with [the tenant/s] to mitigate as much as possible the repercussions of this order.

Ms Thompson-Wise advises that Kāinga Ora will attempt to assist [the tenant/s] to obtain the support she needs at this juncture.

Given [the tenant/s] mental health concerns, I consider it appropriate to suppress her name and identifying details from the published order, see section 95A RTA.
