Both parties attended the hearing.

The landlord filed this application on 20 August 2025 seeking termination/conditional termination and an order for rent arrears on the basis that the rent was 21 days in arrears on the date the application was filed.

Section 55(1)(a) of the Residential Tenancies Act 1986 provides that the Tribunal shall make an order terminating the tenant if it is satisfied that on the date the application was filed the rent was 21 days in arrears. The Tribunal may also make a conditional termination order if is satisfied that tenant will pay any rent arrears within a period specified by the Tribunal and is unlikely to commit any further breach.

At the date the application was filed rent was $936.01 in arrears. The rent for the tenancy is $204.00 per week. So rent at the date of filing was 32 days in arrears.

The landlord filed an updated rent summary for the hearing today. That rent summary shows that rent was $336.01 as at 6 October 2025 (yesterday). The rent is therefore now 11 days in arrears.

The tenant explained that her benefit was cut off and it took some time to have it reconnected and for payments to start again. She then paid the sum of $600 as a lump sum, and has paid rent on time since.

The landlord has proved that the rent is in arrears and the tenant accepts the arrears as claimed.

The tenant wishes to pay off the arrears at the rate of $30.00 per week in addition to her current rent, starting with the next rent payment, which is due on 14 October 2025.

The landlord is content for the tenant to pay off the arrears at a rate of $30.00 per week.

On the basis of the discussions between the parties, and the payment arrangement discussed, the tenant will have paid the arrears in full by 30 December 2025.

I suggest that the parties keep in close contact to discuss the dates and timing of the additional payments so that the total amount is paid by the date specified.

In the event that the arrears have not been paid in full by that date, the landlord may apply to reopen this matter (they may apply up to and including 30 January 2026) and seek further orders.

As the parties we able to reach agreement on the payment of arrears I consider that there is no public interest in publication of the tenant’s name and so have made a suppression order accordingly.
