Ms Herbert, representing the landlord, and Mr Matthews, the tenant, both attended the teleconference hearing.

The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.

Should the tenancy be terminated?

The tenant acknowledged he has been in rent arrears for a while, that the rent arrears is a significant amount and that his last rent payment was on 28 July 2025. However, he said he has suffered financial hardship, does not have a current job, and that WINZ have cut him off until November 2025. The tenant said he is starting a course and will have Studylink and that he is setting up some businesses. He indicated he has had difficulties with boarders coming and going and not paying him also, but now has a boarder. The tenant emphasised he has experienced many personal and family difficulties also. He said he could apply for Kiwisaver hardship, but acknowledged he has not organised that so far. The tenant asked for more time to pay off the rent arrears and stay in his property.

The tenant has been in arrears for about a year, with the rent arrears increasing steadily over that time. The tenant has not paid rent for about the last 10 weeks before the hearing either. Rent arrears are now a significant amount. The tenant did not satisfy me, based on his evidence, that he would pay the rent arrears within a time specified by the Tribunal, nor that it was unlikely he would commit any further rent payment breaches. Therefore, I was not satisfied that a conditional termination order could be made pursuant to section 55(1A) of the Residential Tenancies Act 1986 (“RTA”).

Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.

How much rent is owing?

The landlord provided rent records which prove the amount owing to 6 October 2025, which is $8,116.72. Weekly rent is $408.00 so daily rent is $58.28. A further one day’s rent @ $58.28 is payable for 7 October 2025. Therefore, the tenant owes the landlord a total in rent of $8,175.00 to 7 October 2025, which is the end of the tenancy. Refund of the bond

The Bond Centre is to pay the bond of $1,060.00 (3526959-020) to Trust House Limited immediately. Filing fee

The landlord did not claim for reimbursement of the filing fee. Previous Mediator’s order

This order was issued earlier the same day omitting to deal with a previous Mediator’s order in this matter. This order has been amended to provide for this.

As such, this order replaces the Mediator’s order in application 5071030 dated 10 February 2025, sealed on 11 February 2025. Suppression

The landlord did not request name suppression. The tenant requested name suppression, saying he did not want his name published. However, the tenant was not successful with the claim, nor was there any evidence provided as to whether the tenant’s interests outweighed the public interest in publishing his name. Therefore, I do not grant name suppression to the tenant. See sections 95A(1) and 95A(4) of the RTA.
