Reasons

The Landlord attended the hearing. The Tenant was called twice but did not answer.
Although the application was filed on the basis of abandonment under section 61 of the Residential Tenancies Act 1986 (the Act), the Tribunal notes that the landlord’s application included a claim for rent arrears in the amount of $5,050.
The Tribunal is satisfied that at the date the application was filed, the rent was at least 21 days in arrears. The Tenant has been served but has not responded or appeared. The Tenant has returned to the property and is resisting the Landlord’s attempts to engage with her.
In accordance with sections 55(1)(a), 77, and 85 of the Act, and having regard to the substantial merits and justice of the case, the Tribunal determines the matter under section 55 and makes an order terminating the tenancy accordingly.
Finally, the application was filed in the approved form and with the prescribed fee, meeting the requirements of section 86. While the application was originally framed under section 61, it included a quantified rent arrears claim and a rent summary. The tenant was served, had notice of the arrears, and has not responded. The tenant knew termination was a possible outcome of this proceedings. Consequently, I accept the landlord’s oral submission to proceed under section 55(1)(a). This does not require further service, as the variation does not introduce a new claim but relies on facts already before the Tribunal. In the circumstances, and applying sections 77 and 85, it is appropriate to determine the matter under section 55.
