Both parties attended the hearing which was held by teleconference.
The background to this claim is that Mr Upreti and Mr Shrestha were flatmates and a room rental agreement evidencing this was signed on 25 July 2024. At that time the rent was $150.00 per week and it was agreed evidence that Mr Upreti gave Mr Shrestha $800.00 as bond in cash. This was not lodged at the Bond Centre.
On 1 October 2024 a new agreement was signed on a Residential Tenancies Act form. Mr Shrestha was no longer living at the premises and was subletting them. He was therefore acting as the landlord, rather than a flatmate.
The tenancy ended on 26 August 2025 and Mr Upreti makes a claim in the Tribunal against Mr Shrestha for the $800.00 he originally paid in bond. He also seeks reimbursement of the filing fee.
The Tenancy Tribunal only has the jurisdiction to hear claims between landlords and tenants. It does not have the jurisdiction to hear claims between flatmates.
The Tenancy Tribunal will therefore only hear that part of the claim which relates to the agreement on 1 October 2024.
Section 22B(2) of the Residential Tenancies Act 1986 provides that if the tenant applies to the Tribunal for payment of the bond, and the landlord seeks payment from the bond in whole or in part, the landlord must file an application to the Tribunal that sets out the landlord’s claim.
Mr Shrestha has not made an application to the Tribunal and in accordance with the provisions of s22B(2) I must therefore return the bond paid by the tenant, Mr Upreti.
It was agreed at today’s hearing that the bond paid pursuant to the tenancy agreement of 1 October 2024 was $500.00. Mr Shrestha must therefore repay this $500.00 to Mr Upreti.
I note that a Disputes Tribunal decision dated 30 July 2025 which rejected jurisdiction, says that the original $800.00 paid in bond was transferred pursuant to the second agreement. At today’s hearing the parties agreed that this was not in fact correct and the bond pursuant to the second agreement was $500.00, and not $800.00.
I advised the parties that if they wish to make a claim against the other for matters prior to 1 October 2024, then that is a matter for the Disputes Tribunal to hear because prior to 1 October 2024 the parties were flatmates.
Any claim relating to issues subsequent to 1 October 2024 should be made to the Tenancy Tribunal.
As stated earlier, given that the second agreement records the bond as being $500.00, this is the amount that Mr Shrestha must pay Mr Upreti.
I am also ordering Mr Shrestha to reimburse the filing fee to Mr Upreti because the tenant was substantially successful with the claim against him. C ter Haar 09 December 2025
