Order
- [The tenant/s] owes Kāinga Ora–Homes And Communities $512.00 (“the debt”) being rent arrears to 3 November 2025.
- [The tenant/s] must pay rent and the debt as follows: a. By weekly payments of $184.00, being $134.00 for current weekly rent and $50.00 for the debt. b. Payments will be made every Tuesday, with the first payment due on Tuesday 4 November 2025, until the arrears are paid .
- Payments will be allocated in the following order: current rent then rent arrears.
- If the tenant fails to pay rent and rent arrears within 5 working days of the due dates: a. The tenancy at Unit/Flat Flat 6, 14 Laurelia Place, Wiri, Auckland 2104 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.
Reasons
- The landlord attended the hearing today.
- The landlord has applied for termination of the tenancy for rent arrears. The arrears are much reduced compared to the position when the application was filed. This is the result of an adjustment to the income-related rent in the tenant’s favour. The arrears are now $512.00 with an income-related rent of $134.00.
- The tenant has started making weekly payments of $50.00 towards the arrears. This order formalises the arrangement. I am satisfied the tenant will pay the debt within the period specified in the order and is unlikely to commit any further relevant breach. I have granted a conditional termination order.
- The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach.
