This matter is determined as indicated by the orders above, but the landlord is granted a period of 90 days within which, if the rubbish and puppy are not removed and if there is an unauthorised dog at the premises, then the landlord can request that the application be brought back before to the Tribunal with new evidence in respect of the breaches and the matter will be re-opened.

Both parties attended the hearing.

The landlord has applied for work orders in a last bid to keep the tenancy. If the work orders are not complied with then the landlord will ask the Tribunal for an order ending the tenancy. There are two issues – the rubbish and the dogs.

Under section 40(1)(a)-(e), Residential Tenancies Act 1986 (RTA) , a tenant has specific obligations in relation to the tenancy premises. Where the Tribunal finds the tenant has failed to comply with any of these obligations, where appropriate it may make an order for the landlord to carry out the work. See section 78(1)(e) RTA.

I have seen photos and I agree the house is not in a reasonable condition because of the rubbish which has been left outside. The landlord wants the problem fixed. The tenant has agreed to remove the rubbish and this will be done by 1 December 2025.

The other issue is the dogs. At the moment the tenant has one puppy and one dog, his dog, at the house. He does not have the landlord’s permission to keep dogs. The tenant said he will find a home for the puppy. I find the puppy must be removed from the house by 16 November 2025.

The landlord said it would consider a new application for one adult labrador to live at the house. The landlord will provide a new pet application form tomorrow. The tenant has agreed to file a new application. I find this must be done by 17 November 2025.

If the work order is not being made by consent of both parties, the Tribunal must also make a monetary order as an alternative to compliance with the work order. I record that the rubbish removal order has been made by consent and I do not find it is appropriate to make a monetary order relating to the dogs. See sections 78(2) and 78(2AA) RTA.
