The tenant has made progress in demolishing the structure and having some items removed from the property. However, the tenant explained that she needs to obtain a large skip bin so that this work can be completed. She does not have the money to order a skip bin and will make an application to the Ministry of Social Development for financial assistance.

This tenancy began over eleven years ago. Both the tenant and the landlord wish to see it continue as it is the home of the tenant and her four children. For this reason, the landlord has not sought immediate termination for the tenant’s continued breach of the Residential Tenancies Act 1986 and the tenancy agreement.

However, a termination order will be made if the tenant does not comply with this order for the removal of the structure, its material and rubbish around the premises. The Ministry is therefore requested to urgently fund the required skip bin so that the tenant can comply with this order and retain her home.

If the tenant does not comply with this order, then the landlord can supply evidence of the tenant’s non-compliance and request the Tribunal to re-open its application for termination.
