The landlord has applied for compensation and reimbursement of the filing fee following the end of the tenancy.

Did the tenant comply with his obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
The tenant did not leave the premises reasonably clean and tidy. Every surface of the apartment was covered in rubbish. The claim for cleaning is proved and allowed.
The landlord provided a number of power invoices with the application. These were served on the tenant. It was unclear exactly what the landlord was claiming. He clarified at the hearing that he wants the tenant to pay $276 owing for power bills from 14 February 2025 until 19 August 2025. These bills were for an account in the tenant’s name. This is not an order the Tribunal would usually make because the power contract was between the tenant and the power company, not the landlord and the tenant.
The reason the landlord wants the Tribunal to make an order is because of a Body Corporate rule which requires owners to guarantee the payment of power. The landlord did not provide me any supporting documentation to prove the BC rule or that the owner will have to pay. The landlord asked for additional time to submit the relevant information but the 45 minute hearing had already been stood down for 15 minutes so the landlord could provide the photos taken at the final inspection. I find the landlord has not proved the owner will suffer a loss so this claim is dismissed.
Because the landlord has substantially succeeded with the claim I have reimbursed the filing fee.
