Reasons

Neither the landlord nor the tenant attended the hearing on 18 February 2026. The landlord’s husband attended the hearing on behalf of the landlord but no application for representation was filed. The landlord’s husband advised that the landlord is in Malaysia.
On the evening before the hearing the tenant emailed Tenancy Services to advise she could not attend the hearing as her child was unwell. She sent some documents in support of her application.
The tenant applied for refund of the bond.
The landlord applied for compensation and exemplary damages related to damage caused at the premises.
The landlord had not filed any evidence to support the claims that the tenant caused damage. During the hearing the Tribunal provided the landlord’s husband with an opportunity to produce the documents required but he only managed to produce three photographs.
The landlord’s husband referred to damage caused by the tenant to the gutter. He said that he did not have any pre tenancy photographs of the gutter and no invoices.
The landlord’s husband also referred to a damaged marble benchtop but again there were no photographs from before the tenancy commenced and no invoices.
To succeed in a claim for damages to the premises the landlord should provide photographs of the premises from before this tenant moved in, photographs of the damage after the tenancy and invoices for the repairs required.
The applicant is required to establish the claim to the civil law standard of proof, on the balance of probabilities. The applicant has not satisfied me that it is more likely than not that the tenant caused damage to the premises.
The landlord also claimed petrol for travel between the landlord’s home south of Auckland and the tenancy address. This is not a cost for the tenant and instead is one for the landlord.
The landlord’s claim is dismissed. As the landlord has been unsuccessful the bond is released to the tenant.
Because [The tenant/s] has wholly succeeded with the claim I must reimburse the filing fee. As the successful party the tenant is also entitled to name suppression as sought.
