Both parties attended the hearing, which was conducted by phone. Ms Gray represented the landlord, and Ms E represented Mr V.
The landlord has applied for possession of the premises following the termination of the tenancy.
The tenant, [...], sadly passed away on 2 August 2025.
As noted in an order I made on 22 October 2025, 50A sets out the ways in which a tenancy agreement ends where there is only one tenant and the tenant has died.
On 15 September 2025 the Kainga Ora gave formal written notice under section 50A(1)(b) of the Residential Tenancies Act 1986 (the Act) that the tenancy would end on 8 October 2025.
On 14 October 2025, the landlord applied for a possession order under section 64.
On 22 October, I determined that the tenancy had not been assigned to Mr V and that there was no unwritten tenancy agreement between them. The landlord has not granted Mr V the right to occupy the premises.
Because the notice to the parties stipulated that the hearing on 22 October was for jurisdiction only, I did not determine the landlord’s application for possession. It was therefore adjourned to today.
I am satisfied that the tenancy terminated on 8 October 2025 and that the landlord is entitled to possession under section 64 immediately. Ms Gray has agreed to allow Mr Va further week and two days. Possession is granted to Kainga Ora Homes and Communities at 10am next Friday 7 November 2025.
Any enforcement action must be taken within 90 days of 7 November 2025.
Because this matter concerns the estate of a tenant, I have ordered name suppression of the tenant’s name and identifying details. That includes the names of Mr V and Ms E.
