The tenant agrees to and must carry out the following work to the premises, which must be completed by 12 noon on Friday 30 January 2026: a. Remove rubbish from the outside of the property (including carpet and underlay, rubbish bags, old tyres, old building materials, old engines or mechanical parts, and any broken items), and b. Move some other items the tenant wants to keep to the inside of the garage (eg; the paint and paint shelf, plastic crates, scaffolding, trolleys, gym equipment).

The tenant is allowed to keep the lawnmower, lawnmower petrol cans, bikes, plastic outdoor chairs, ladder, and wheelbarrow outside.

If the tenant does not comply with Order 2a and 2b above, then the landlord may remove any of the carpet and underlay, rubbish bags, old tyres and building materials, old engines or mechanical parts, paint and paint tins, plastic crates, scaffolding, trolleys, and gym equipment that remain outside, and charge the tenant the costs of this work up to $500.00. These costs may be treated as rent in arrears and enforced accordingly.

If the tenant wants to construct or install an outdoor shed at the property, he must first get written consent from the landlord.

The landlord wants an order from the Tribunal that the tenant must remove some rubbish and other large items from outside of the premises.

The landlord says the order to remove the dog, and the boat, are no longer needed. These have already been removed.

Can a landlord tell a tenant they must remove rubbish and other items?

Under the law and the tenancy contract, a tenant must “keep the premises reasonably clean and reasonably tidy”. See section 40(1)(c) Residential Tenancies Act 1986 (RTA).

The reason for this is to make sure there are no health and safety risks.

The photos show me the property does not have a big outdoor area. There is not much room to store things outside.

The risk is that people might hurt themselves on the objects, or pests like rats can hide under old carpet. Work orders made by consent

The tenant has done a good job taking away some of the items, but I agree there is still some rubbish that needs to be removed.

[The respondent/s] agrees to remove the old carpet and other rubbish items. He would like to arrange this himself because it will be cheaper.

The landlord agrees to allow until Friday 30 January 2026 for him to do this.

I have also made an order that if the rubbish is not removed and other items moved into the garage by the date agreed, then the landlord can remove the items listed and charge the tenant up to $500.00 for this. These costs can be treated as rent in arrears and enforced accordingly. See sections 78(2AAB) and 78(2AAC)(a) Residential Tenancies Act 1986.

What can the tenant keep outside?

It is reasonable for a tenant to keep some outdoor things like the lawnmower, bikes, wheelbarrow and garden tools, and ladder outside.

The application for a work order to remove items has been proven however the tenant attended the hearing and has been constructive and realistic in taking action to address the issues. My decision is that the tenant’s interests in privacy and future renting prospects outweigh the public interest on this occasion. The tenant’s name is suppressed (with the support of the landlord).
