Did the tenant comply with their obligations at the end of the tenancy?
- At the end of the tenancy the tenant must leave the premises, including the carpets in reasonably clean and tidy condition. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
- The landlord provided evidence to show that the carpets were clean and free of stains at the beginning of the tenancy and stained and grubby at the end of the tenancy.
- I accept the landlord’s evidence that the photos were taken on the day the tenancy ended. While the tenant might doubt the date of the photos the landlord provided affirmed evidence that she took the photos herself and on the last date of the tenancy. The tenant has not provided any evidence to show that the landlord’s evidence cannot be relied on as accurate.
- While I accept that the tenant cleaned the carpets earlier in the tenancy that was in response to the landlord issuing a 14-day notice regarding cleanliness and does not mean that staining could not have occurred again after this, which is the more likely explanation for the condition of the carpets at the end of the tenancy.
- I have also awarded almost all of the cleaning cost claimed as the photographs provided are good evidence that the oven and stove, shower and walls and windows required cleaning to ensure the property was “reasonably” clean at the end of the tenancy. The small deduction is because tenants need not remove all marks from windows and walls to meet the required standard.
- The amounts ordered are proved.
- The landlord did not request reimbursement of the filing fee.
