An application for suppression has been made in this case, and the Tribunal orders suppression of the Landlord’s name and identifying details.
Cherish Michaela HIMONE-DODD must pay [The landlord/s] $798.00 immediately, calculated as shown in table below.

Reasons

This application was scheduled to be heard by video conference. The tenant did not connect to the Teams link provided to her and when I rang the telephone number that she provided in her tenancy agreement, another person answered the phone and advised that she was the tenant’s aunt. This person also stated that she did not know the tenant’s telephone number. However, I am satisfied that the tenant received notice of today’s hearing and so it proceeded in her absence.
The landlord has applied for compensation and reimbursement of the filing fee.

Is the tenant responsible for the damage to the premises?

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.
Tenants are liable for the cost of repairing damage that is intentional or which results from any activity at the premises that is an imprisonable offence. This applies to anything the tenant does and anything done by a person they are responsible for. See section 49B(1) RTA.
I accept the landlord’s evidence that the tenant advised him that the damage to the ranch slider door and frame had been caused by her son fighting. On this evidence I am satisfied that the tenant ought to pay the full cost of repair because her son, for whom she is responsible, engaged in conduct that was most likely to result in damage. In other words, the damage can be regarded as being so careless as to be intentional.
I also accept the evidence that the tenant agreed to pay the quoted cost of repair but as yet has failed to do so.
On all this evidence I am ordering the tenant to pay the landlord the quoted cost of repair. Filing fee reimbursement
I am also ordering the tenant to reimburse the filing fee to the landlord because the landlord was wholly successful with this claim against her. Suppression of landlord’s name
