The tenant agreed to this on the condition she found a new property to move into. It was agreed that she would need to advise the landlords definitively by 8/9. On 6/9 she found a new property with a start date of 18/9/2025 and arranged movers for that date.

As requested, she advised the landlords on 8/9 that she would have everything moved by 18/9, which she did, leaving the key at the property that day.

The evidence establishes that the tenancy ended early by agreement (and at the landlord’s request on 18/9/2025). The tenant has paid rent until 18/9 and the claim for rent arrears is dismissed.

I am satisfied that the evidence establishes the property was left in a “reasonably clean and tidy condition at the end of the tenancy.

As explained a tenant need not leave a property in an “immaculate” or “spotless” condition. It need not be left so it can be immediately relet or sold. A reasonable landlord will build into their business plan some time and allowance for additional cleaning to ensure a property is in a condition for sale. That is in my view precisely what the $120 here does. It is the additional and minor touch up cleaning that is a landlord and not tenant responsibility.

The claim for cleaning is therefore dismissed.

The applicant has not satisfied me that it is more likely than not that the tenant has breached her obligations with respect to cleaning.

Because [The applicant/s] have not succeeded with their claims I am unable to directed that the tenant must reimburse the filing fee.
