Should the tenancy be terminated?

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. See section 56(1) Residential Tenancies Act 1986.

The landlord served 14-day notices on the tenant on 14 May and 19 September 2025, and the tenant did not remedy the breach within the required period.

It would be inequitable to refuse to terminate the tenancy because: a. It is now some eight months since the property was permanently occupied by the tenant. b. Two notices have been issued and the tenant has not remedied the breach. c. The tenant has made it clear that she does not wish to return to live in the property. d. While being left vacant, the property is deteriorating. e. The landlord as a social housing provider has an obligation to make the house available to a suitable tenant. f. Termination in these circumstances is not a disproportionate response to the breach.

The tenant explained that she believes it is unsafe for her and her two young children to return to the property. She gave evidence that she has been subject to violence and harassment while living there and had applied for a transfer. She confirmed that she does not wish to live at the property. However, she wishes to continue the tenancy until her tenancy is transferred to another property.

The landlord confirmed that the tenant had applied for a transfer and that this was very close to being finalised. The landlord confirmed that the tenant needed to keep her tenancy for it to be transferred.

Both the landlord and the tenant wish to see the tenant transferred to a new property. They both recognise that the landlord needs to take possession of the property and that the tenancy must end. However, neither wishes to have the tenancy end until the tenant’s transfer is complete and so it is important that the tenancy not end immediately.

In these circumstances, it is appropriate that the Tribunal order that the tenancy end in five weeks so that the tenant’s transfer can be completed. The tenancy may end on such earlier date as the parties agree.

Having considered the personal issues facing the tenant and which have contributed to her present predicament, it is appropriate to exercise the discretion in section 95A(4) RTA and order suppression of her name and identifying details.
