The tenant did not attend. The hearing proceeded in her absence.

This was to be a tenant application for reduction of the fixed term. The tenant’s co- tenant had to withdraw from the tenancy due to family violence. For two weeks after the other tenant’s withdrawal, the tenant paid a reduced rent. However, since the expiry of the two weeks she has been liable to pay the full rent.

Because the tenant did not attend, the application could not proceed on that basis. However, the landlord has offered an outcome that would be equivalent to that achieved by the tenant’s application.

Ms Gonzales submitted the landlord was content for the tenancy to end this Sunday, enabling the tenant to move out, clean and tidy the unit, remove all rubbish, return the keys, and attend to any other tenant move-out duties.

That submission is fair. An order for termination and possession is made.

I also order rent arrears and rent to the end of the tenancy.

Ms Gonzales suggests that name suppression is appropriate for the tenant because the situation was the result of family violence, and the tenant is young.

Under s 95A(4) of the Residential Tenancies Act 1986, the Tribunal may, on the application of any party to proceedings or on its own initiative, having regard to the interests of the parties and to the public interest, order that the name or any identifying details of any party not be published.

Having regard to the interests of the parties and the public interest this is a case that non-publication is warranted. The tenant has done nothing wrong. She is a victim of circumstance. The other tenant’s name is automatically suppressed by the Act. There is no public interest in the Tribunal publishing the tenant’s name in the circumstances.

A non-publication order is made.

The bond is to remain at the Bond Centre for now. The relevant parties can agree on its allocation.
