Should the tenancy be terminated?

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. See section 56(1) Residential Tenancies Act 1986.

Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so.

The tenant has breached his obligations by living in conditions which can only be described as squalid. The landlord provided comprehensive photographic evidence of the inside of the premises. Every room in the house is covered in rubbish and old food. The landlord’s concern is that of an imminent fire risk due to the tenant using the oven as a heater coupled with the risks from cigarette ashes inside the house.

The landlord has exhausted all options to assist the tenant. They have undertaken numerous visits to the property which have largely been unsuccessful due to the aggressive and abusive behaviour of the tenant.

The photographs clearly confirm that the current state of the premises is a clear and present danger to not only the tenant but also those living next to him.

The landlord served a 14-day notice on the tenant on 4 September 2025, and the tenant did not remedy the breach within the required period.

It would be inequitable to refuse to terminate the tenancy due to the significant health and safety risks to the tenant and his neighbours coupled with the imminent fire risk. The premises in their current condition are not fit for human habitation.

The claim is established.

The landlord also seeks name suppression for the tenant.

Having heard from the landlord in respect of the tenant’s personal circumstances I am satisfied that publication of the tenant’s name is not in the public interest.

Accordingly, the request for name suppression for the tenant is granted.
