The tenancy of [The tenant/s] tenant/s] at 48 Tui Street, Fendalton, Christchurch 8041 is terminated, and possession is granted to Kirkman Asset Management Limited As Agent For Cyrena, at 11.59 pm on Sunday 28 December 2025.
[The tenant/s] tenant/s] must pay Kirkman Asset Management Limited As Agent For Cyrena $4,815.72 immediately, calculated as shown in table below.
The Bond Centre is to pay the bond of $1,517.14 (BN-00122148) to Kirkman Asset Management Limited As Agent For Cyrena immediately.

Reasons

Both parties attended the hearing which was held by teleconference.
The landlord has applied for termination, rent arrears, refund of the bond and reimbursement of the filing fee following the end of the tenancy.
The tenant said the rent arrears has accrued because he has been in hospital with influenza and blood poisoning. He said he was admitted at the end of October and was in hospital for three to four weeks. The tenant said he also lost his phone and his wallet and has been unable to contact the landlord.
The landlord said the tenancy only began in July 2025 and this is the third time the tenant has been in rent arrears. On a previous occasion the tenant used part of his bond to clear the arrears and said that he would top up the bond again, but this hasn’t happened.
The tenant offered to pay double rent and then access is Kiwisaver to clear the arrears. The landlord responded that this didn’t affect her application for termination of the tenancy.
Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must terminate the tenancy. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
The landlord provided rent records which prove the amount owing at today’s date is $5,347.14. The tenant does not dispute this amount. An adjustment to the arrears has been made in consideration of the notice period until 28 December 2025.
The landlord sought immediate termination; the tenant asked for two weeks. I have given the tenant the benefit of two full weekends to return possession of the property to the landlord.
Because Kirkman Asset Management Limited As Agent For Cyrena has wholly succeeded with the claim I must reimburse the filing fee.
