The Tribunal must hear a claim for outstanding power and gas charges filed by the landlord following the end of the tenancy. History of the tenancy
The tenancy commenced on 3 May 2025 and ended on 22 August 2025.
Following the end of the tenancy, the bond of $750.00 was refunded in full to the landlord to offset outstanding rent debt and outgoings. History of the claim
On 20 November 2025, the landlord filed an application seeking payment of outstanding power and gas charges totalling $622.74.
The matter was first set down for hearing on 12 February 2026. At that hearing the landlord failed to appear. The tenant appeared, and told the Tribunal they accept power and gas charges were owed at the end of the tenancy but disputed the amount claimed. The tenant sough an adjournment to discuss and resolve the issue with their landlord. The hearing was adjourned.
The next heard the claim on 18 March 2026. Ms Gill, Property Manager, appeared for the landlord. The tenant appeared. At that hearing the landlord sought an adjournment to consider the tenant’s evidence, confirm the amount claimed and discuss a possible payment plan to clear the debt.
The matter came before the Tribunal on 30 April 2026. Ms Whitt, Property Manager, appeared for the landlord. The tenant appeared. How much is owed in outstanding power and gas charges following the end of the tenancy?
Under section 39(3) of the Residential Tenancies Act 1986 (the “Act”), the tenant is responsible for all outgoings in respect of the premises that are exclusively attributed to the tenant’s occupation of the premises or to the tenant’s use of the facilities.
The landlord seeks outstanding power and gas charges for the following period: a. 22 May 2025 – 18 June 2025 totalling $281.63; and b. 22 July 2025 – 21 August 2025 totalling $341.11.
The landlord provided the Tribunal with the following evidence in support of their claim: a. A signed tenancy agreement which specified at clause 6(4) the tenant will “pay all electricity, gas, telephone and metered water charges.” b. A Mercury Energy bill for the period 22 May 2025 – 18 June 2025 in the amount of $281.63. c. A Mercury Energy bill for the period 22 July 2025 – 21 August 2025 in the amount of $341.11. d. A tenant invoice dated 5 November 2025 in the amount of $622.74. e. A Tenancy Invoices statement generated on 22 October 2025 showing an outstanding balance of $341.11. f. A Tenancy Invoices statement generated 19 March 2026 showing an outstanding balance of $622.74. This statement contains an unidentified additional charge of $281.63 added on 5 November 2025.
The tenant disputes the amount claimed stating the total balance owing at the end of the tenancy for power and gas charges is $341.11. The tenant provided the following documents in support of their position: a. An e-mail from the landlord dated 29 August 2025 with an attached power bill showing power and gas charges for the period 22 July 2025 – 21 August 2025 totalling $341.11. b. An email from the landlord dated 4 September 2025 stating: “Just an update: As at your vacate date, you have an outstanding balance of $625 for rent and $466.11 for invoices, including the power and gas bill, totaling [sic] $1,091.11. After deducting the bond refund of $750, the remaining amount payable is $341.11.” c. An email and tenancy invoices document from Lynn Property Management Ltd, dated 22 October 2025, seeking to establish a payment plant for outstanding power and gas charges for the period 22 July 2025 – 21 August 2025 totalling $341.11.
The tenant challenged the landlord’s tenancy invoices records saying: a. The additional unidentified charge of $281.63 was added to her account on 5 November 2025, after the tenancy ended. b. The records do not accurately reflect all financial transactions. c. The tenant paid for all power and gas used at the commencement of the tenancy as the Property Manager was “vigilant” about collecting payment. d. The landlord confirmed to her via email on 4 September 2025 and then on 22 October 2025 that the total debt owing at the end of the tenancy was $341.11. Analysis and decision
Having heard from the parties and considering all of the evidence the Tribunal is not satisfied on the evidence provided that the total amount claimed at the end of the tenancy is proved.
The tenant was told by the landlord on at least two occasions that the total amount owing at the end of the tenancy totalled $341.11. The tenant should have been able to rely on this figure.
The bond was refunded in full to the landlord and was used to off-set outstanding rent arrears and outgoings. This refund of the bond was not particularised on the tenant’s Tenancy Invoices account spreadsheet.
The landlord could not provide an explanation as to why the unidentified additional charge of $281.63 was added to the tenant’s account two and a half months after the tenancy ended. However, it was suggested the bill may have been overlooked before being added at a later date (after discovery of the bill).
For the Tribunal to award the amount claimed for outstanding power and gas charges, it must be satisfied on the balance of probabilities that the landlord has proved the amount owed. Based on the available evidence, in particular the Tenancy Invoices documents, the Tribunal cannot be satisfied the amount claimed has been proved. That is because the Tenancy Invoices document contains a number of unidentified transactions and an unidentified charge incurred after the tenancy ended. These factors raise doubt about the reliability and accuracy of the document.
The tenant accepts liability for outstanding power and gas charges totalling $341.11 and that is what is ordered. Other matters
Because Lynn Property Management Limited has substantially succeeded with the claim I have reimbursed the filing fee.
Under section 95A of the Act a party who has been either wholly or substantially successful is entitled to name suppression unless the Tribunal finds that there are reasons relating to the conduct of the party not to do so.
The tenant has been substantially successful in defence of the landlord’s claim and is granted name suppression.
