Reasons

The landlord attended the hearing, the tenant did not attend.

This was a part heard matter. On 16 December 2025, the Tribunal ordered the tenant to pay $8086.19 in compensation for damages, rent arrears, key, and alarm remote replacement and filing fee. The bond of $2600.00 was refunded to the landlord to offset the debt owed by the tenant to the landlord. The outstanding balance to be paid by the tenant is $5486.19.

The earlier hearing was adjourned to allow the landlord to provided proof for some of his claims and to hear the tenants’ claims.

When the 16 December 2025 date was scheduled, it was only for the landlord’s claims. However, the tenant filed a counter claim and there was not enough time to deal with both claims together.

At this hearing, the tenant failed to appear, therefore I am dismissing all the tenants’ claims.

The landlord’s remaining claims are for the final water, power, and gas bills and the fine imposed on the owner of the property for the tenants illegal parking.

The tenancy ended on 23 October 2025. The landlord provided water rates invoices, power and gas bills which prove the amounts owing at the end of the tenancy. The water bill was $106.82, power bill $285.25 and gas bill $54.54.

I am satisfied that the landlord has proven their claim for the power, gas, and water bill. Car Parking Fine:

The property is in a complex with a Body Corporate. The Body Corporate manages and maintains the common property. There are restrictions on where residents and their visitors can park within the complex.

The landlord provided photographs of the tenant’s vehicle and her visitors parking in restricted areas of the complex. The landlord provided emails between himself and the Body Corporate over the fines he had to pay for the tenant’s breach of the complex rules.

The landlord paid $100.00 for fines.

I am satisfied that the landlord has proven his claim for the car parking fine.

The landlord raised a few concerns regarding the award from my previous order, in particular regarding depreciation. Depreciation:

When considering compensation for damage to items such as carpet, curtains, or appliances, the Tribunal must take into account the principle of depreciation. This means that compensation is not based on the full replacement cost of a new item, but rather on the value of the item at the time it was damaged, taking into account its age, condition, and expected lifespan. The Tribunal applies straight- line depreciation using established guidelines, such as the Tribunal’s depreciation table or the Inland Revenue General Depreciation Rates (IR 265). If the item was already part-way through its useful life, the amount awarded will be reduced accordingly, to ensure the landlord is not placed in a better position than if the damage had not occurred. For example, if carpet with an expected lifespan of 10 years is damaged after 5 years, only half the replacement cost may be awarded, subject to evidence of the item’s condition at the start of the tenancy and any other relevant factors.

The landlord queried the amount of rent arrears awarded in the previous order. Unfortunately, I cannot reconsider that as I have already dealt with it and at the time of the previous hearing the information provided supported that award. The landlord is in a position to file a rehearing or appeal if he is disputing that decision.

The tenant still has not paid or made contact with the landlord regarding the outstanding debt she owes from the previous order. The landlord now seeks enforcement of the previous order through the District Court.

All matters relating to the landlord’s claims have now been completed and the tenants are dismissed because she failed to appear at the hearing and has not communicated with the Tribunal seeking an adjournment.
