The landlord attended the hearing by telephone.

The tenant was telephoned on one number but did not answer. The tenant was telephoned twice on a number given to the landlord on 21 October 2025 but he did not answer and messages were left.

The landlord has applied for termination of the tenancy for abandonment and rent arrears.

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.

The landlord suspected that the tenant was not living at the property as required by clause 14 of the tenancy agreement. It issued a 14-day breach letter on 5 September 2025. It inspected the property on 30 September, 7 October and 16 October 2025 and provided the inspection reports as evidence.

The power has been disconnected and it is clear that nobody is living at the property and that the tenant has abandoned it.

The landlord advised that the last communication it had with the tenant was by email on 21 October 2025 when he advised that he was caring for a grandchild who was in hospital. He indicated that he was wanting a transfer of tenancy. He provided a new contact telephone number but has not responded to calls from the landlord.

On this evidence, the Tribunal determines that 21 October 2025 was the date when the landlord became aware (or ought to have been aware) that the tenant had abandoned the premises.

Because the premises have been abandoned, and rent is in arrear, the tenancy is terminated immediately.
