If the tenant fails to pay the debt in full by midnight on 02 February 2026: a. The tenancy at [Tenancy address suppressed] will terminate and the landlord will have immediate possession of the premises. b. The debt will be payable immediately.

Reasons

The tenant appeared in person. Ms Thompson – Wise appeared for the landlord by telephone.

The tenancy commenced on 14 March 2013 and is periodic. On 24 November 2025, the landlord filed a claim seeking termination of the tenancy for rent arrears of more than 21 days. Law

Under section 55(1)(a) of the Residential Tenancies Act 1986 (Act), the Tribunal must terminate the tenancy if the rent is at least 21 days in arrears on the date the application was filed.

Section 55(1A) of the Act provides that the Tribunal may, instead of making a final order under 55(1)(a), issue a conditional termination order if it is satisfied the tenant will repay the arrears within a specified period and that a similar breach is unlikely to occur again. Analysis

The tenant stated that due to defects with the property they unilaterally ceased paying rent.

The landlord states that they are aware the tenant obtained a Healthy Homes assessment, but that the tenant declined to share the report and also declined a request for an inspection of the property.

Despite the alleged defects with the property, the tenant stated that they do not wish to vacate.

The tenant has a history of accumulating rent arrears and subsequently settling them in full. There is also a history of failed mediated agreements, including a breach of a conditional termination issued in April 2025, which was not enforced by the landlord.

The Tribunal initially struggled to identify grounds on which to order a conditional termination. A tenant who ceases paying rent on the basis that they consider themselves excused due to the condition of the property runs the risk of the tenancy being terminated for rent arrears. The tenant has not filed a counterclaim that might be relevant to any offset reducing the arrears owed, although the tenant stated that they had intended to do so.

They advised that they intend to seek support from MSD to clear the rent arrears, after which they plan to file their own application with the Tribunal.

I grant a conditional termination order.

Despite the failures to comply with previous agreements, by the narrowest of margins, I am satisfied that the tenant is in a position to clear the arrears. Having had the benefit of appearing before the Tribunal today, and understanding the immediacy of the situation, I am also satisfied that the tenant is unlikely to commit any further relevant breach.

The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the breach. See section 64(4)(b) of the Act. Name suppression

The landlord does not seek name suppression. The tenant has avoided immediate termination and has also given evidence concerning their mental health. I am satisfied that there are grounds to exercise the discretion in section 95A (4) of the Act and order suppression of the tenant’s name and the address of the property.
