Reasons

Ms Wyatt and Mr Olds represented the landlord. The tenant did not attend the hearing.

The landlord has applied to terminate the tenancy because the tenant assaulted another tenant as well as that tenant’s mother and sister.

The Tribunal must terminate a tenancy where the tenant has assaulted, or has threatened to assault, any neighbour of the premises 1 .

The tenant whom this tenant assaulted was a neighbour of the premises. Both tenants live in the same section of this social housing complex, in different parts of the same premises.

The Tribunal has a limited discretion not to make an order terminating a tenancy. The discretion applies if, but only if, the breach has been remedied, the landlord has been compensated for any loss, and it is unlikely that the tenant will commit any further breach of a kind to which the section applies 2 .

The Tribunal heard evidence from the tenant whom this tenant assaulted as well as from his mother and sister, both of whom were also assaulted.

It is the assault of the neighbouring tenant that is the focus of the application.

The assault on the affected tenant was serious and sustained and involved a weapon, a pair of scissors. The tenant who committed the assault has been charged with various criminal offences arising from the incident that occurred on 23 November 2025.

Both other witnesses confirmed that the assault took place and described it in detail in their evidence.

This is not a case where the breach can be remedied or where the landlord can be compensated for the loss. That leaves the Tribunal to consider whether it is unlikely that the tenant would commit a further breach (an assault) again.

Given the evidence of the tenant who was assaulted, and the other witnesses, the Tribunal cannot be satisfied that the tenant would not commit a similar breach. The landlord’s representatives gave evidence of the tenant’s past anti- social behaviour. They noted that the assault occurred when the tenant appeared to be highly intoxicated.

The effects of the assault have been significant for the neighbouring tenant. He was visibly upset when giving his evidence to a point where I allowed Mr Olds to read his witness statement.
