The tenancy of Ian Gillespie at [Tenancy address suppressed] is terminated, and possession is granted to [The landlord/s], at 11.59am on Tuesday 6 January 2026.
Ian Gillespie must pay [The landlord/s] $28.00 immediately, calculated as shown in the table below:

The landlord attended the video hearing.
The tenant did not attend the hearing by Teams video link nor by telephone. Instructions on attending the hearing by Teams video link or by telephone were included in the Notice of Hearing sent to the tenant. The Tribunal may hear matters in the absence of a party where satisfied that notice of the hearing has been given. I am satisfied that notice of the hearing was given to the tenant.
The tenant had previously applied for an adjournment of the hearing on the two grounds. Firstly, that he was unable to access the hearing by Teams video link and secondly that he wished to obtain legal advice and his solicitor was unavailable.
The tenant’s application for an adjournment was dismissed.
The tenant was provided with information in the Notice of Hearing setting out how to attend the hearing by telephone. I record that no request to attend from the tenant was received during the hearing itself.
Section 85 Residential Tenancies Act 1986 (“RTA”) Requires the Tribunal to deal with matters expeditiously.
Section 93 RTA sets out the basis on which a party may be represented. The Tribunal is essentially a lay Tribunal. Section 93 RTA provides that a party may apply to be represented where; • The other party consents. • The amount in dispute exceeds $6,000.00; or • Where the Tribunal considers it would be appropriate having regard to the nature and complexity of the issues involved or where there is a significant disparity between the parties affecting their ability to represent their respective cases.
None of those factors were present and the tenant had sufficient time prior to the hearing to obtain legal advice.
This is a periodic tenancy. The tenancy commenced on 18 August 2015.
The landlord has applied to the Tribunal for an order terminating the periodic tenancy on the grounds of anti-social behaviour from the tenant.
The landlord states that the anti-social behaviour is;
On 7 November 2025, the tenant responded to an email reminder from the landlord about unpaid rent, by sending an email to the landlord which said, “Fuck off”. An anti-social behaviour notice was issued by the landlord as a result.
On 15 November 2025, the tenant sent an email to Ms A, a staff member of the landlord. The email refers to the tenant previously working as a pimp for a dominatrix. The tenant said “ But going back to you....With encouragement and flourish the Therapist employed me as a pimp to her Dominatrix routine in AKL....We, you and me, could have pulled !0K US/day at least for 4 hours work with your verity intack.....hugs, Ian”.(sic)
An anti-social behaviour notice was issued. The landlord explained by way of history that there had been prior incidents of the tenant harassing Ms A. It had got to the point where a different staff member had been allocated to deal with the tenancy.
On 20 November 2025, the tenant went to the landlord’s offices and left an envelope for Ms A. The envelope contained a handwritten note and other documents indicating that the parties may have been able to have a relationship. It states “us in another life. Xx” and “You and me another life.” Ms A, who gave evidence at the hearing, said she found the note to be very upsetting. An anti- social behaviour notice was issued.
The Police served a notice dated 22 November 2025 on the tenant. The notice refers to harassment of Ms A by the tenant. A trespass notice was issued by the landlord preventing the tenant from attending their offices.
Subject to certain considerations, the Tribunal must make an order terminating the tenancy if it is satisfied: a. on 3 separate occasions within a 90-day period the tenant, or a person in the premises with the tenant’s permission, engaged in anti-social behaviour in connection with the tenancy; and b. on each occasion the landlord gave the tenant written notice— i. describing clearly which specific behaviour was considered to be anti- social and (if known to the landlord) who engaged in it; and ii. advising the tenant of the date, approximate time, and location of the behaviour; and iii. stating how many other notices (if any) the landlord has given the tenant under this paragraph in connection with the same tenancy and the same 90-day period; and iv. advising the tenant of the tenant’s right to make an application to the Tribunal challenging the notice and; c. the landlord’s application to the Tribunal was made within 28 days after the landlord gave the third notice.
The Act confirms that antisocial behaviour includes harassment or any act (whether intentional or not) that reasonably causes alarm, distress or nuisance that is more than minor.
I have taken into account the evidence presented by the landlord as set out above.
I have determined that the landlord has established that the tenant has engaged in anti-social behaviour in connection with the tenancy. The landlord has served notices on the tenant as required in the Residential Tenancies Act 1986, and the application to the Tribunal was made within 28 days of the date of the third notice.
I consider it would not be unfair to terminate the tenancy taking into account the circumstances in which the behaviour arose, and the notices were given. I cannot see that the landlord has acted in any retaliatory way in bringing this application.
I cannot consider the impact on the tenant, in making an order for termination of the tenancy.
As [The applicant/s] has wholly succeeded with the claim I must reimburse the filing fee.
As the landlord has been wholly successful in this matter and as a result of the nature of the application, suppression of the landlord’s name and details and any details relating to staff of the landlord is suppressed.
