- Kāinga Ora–Homes And Communities is granted possession of the premises at Unit/Flat 3, 1 Puatahi Marae Road, Warkworth, Warkworth 0984 as at 11.59 pm 24 December 2025.
Reasons
- The Tenant has lived at the premises since 7 July 2011. The premises are located on papakāinga land. In July 2025, Kāinga Ora decided to divest the premises (and two other Kāinga Ora properties) to the landowner, Puatahi Marae Trust.
- On 7 August 2025, Kāinga Ora issued a notice stating that the tenancy would end on 12 November 2025. The Tenant has not moved out, so Kāinga Ora has applied for a possession order.
- The Tenant has always been prepared to move out but wanted to ensure that her grandchildren’s school year was completed, and that any alternative accommodation was near an appropriate school. Kāinga Ora has now found appropriate alternative accommodation, and the Tenant has agreed to move there.
- By consent, the parties therefore agree that Kāinga Ora will have possession of the premises from 11.59 pm 24 December 2025. I order accordingly.
