Kāinga Ora seeks an order under section 64(1) of the Residential Tenancies Act 1986 for possession of the premises. Background
The Tenant has lived at the premises since 17 October 2014. In August 2025, Kāinga Ora decided to redevelop the premises. On 8 August 2025, Kāinga Ora issued a notice stating that the tenancy would terminate on 12 November 2025.
Kāinga Ora has attempted to find alternative accommodation for the Tenant. Notwithstanding the notice to the terminate the tenancy and Kāinga Ora’s efforts to find alternative accommodation for her, the Tenant has not yet moved out.
The Tenant says that alternative accommodation offered to her does not meet her needs. She says she is ready to move once an appropriate alternative has been found. Assessment
This is a periodic tenancy. Kāinga Ora was entitled to terminate the tenancy by giving at least 90 days’ notice. 1 Kāinga Ora did so on 8 August 2025, when it gave notice to the Tenant that the tenancy would terminate on 12 November 2025. That notice complied with all the formal requirements in section 51 of the Residential Tenancies Act and was a valid termination of the tenancy.
Because the tenancy terminated on 12 November 2025, Kāinga Ora was entitled to possession from that date. I therefore grant its application, and order that possession of the premises is granted to Kāinga Ora immediately.
In making this order, I note that Kāinga Ora will continue to work with the Tenant to find appropriate alternative accommodation and does not intend to exercise its right to possession immediately. I am hopeful that a solution can be reached, but the Tenant must bear in mind that Kāinga Ora now has the right to take possession of the premises if no solution is reached.
