Reasons
- This application was scheduled to be heard by video conference. The tenant did not connect to the Teams link provided to her and both calls I made to her telephone number went to voicemail. The hearing proceeded in her absence.
- The landlord has applied for termination of the tenancy for abandonment, rent arrears, reimbursement of the filing fee and payment of the bond.
Should the tenancy be terminated?
- The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
- On 14 November 2025 the landlord went to the premises and became aware that the tenant had abandoned the premises.
- Because the premises have been abandoned, and rent is in arrear, the tenancy is terminated immediately.
How much does the tenant owe?
- The landlord provided rent records which prove the amount owing as at today’s date. The amount ordered includes rent in lieu of notice.
- I also note that this is a fixed term tenancy and the tenant is required to pay rent until the expiry of the fixed term or until the date that a new tenancy starts.
- I am also ordering the tenant to reimburse the filing fee to the landlord because the landlord was wholly successful with this claim against her.
- Further to this, at today’s hearing the landlord withdrew the claims for a lease break fee and garden work because those costs have not yet been incurred. They may be brought at a later date. C ter Haar 03 February 2026
