Reasons
- Both parties attended the hearing.
- The landlord had applied for compensation following the ned of the tenancy. The application was withdrawn before the hearing.
- The tenant had applied for refund of the bond and compensation for infrastructure electricity charges.
- Since the landlord has withdrawn its application, the bond must be refunded to the tenant. See s22B Residential Tenancies Act. I have made an order accordingly.
- The tenant also sought reimbursement of infrastructure it claims it incurred, but which it says should have been the landlord’s responsibility. The tenant did not provide any documentary evidence in support of that claim. She believed that she had submitted relevant information and said that it may be on another Tribunal file. I was able to access the other file during the hearing; there was no such evidence on the file. The claim for compensation for electricity charges is dismissed.
- As the tenant was the successful party, I have awarded reimbursement of the Tribunal application fee.
